Apex Rescue Publications – Terms and Conditions

Acceptance of terms

By accessing or using the Apex Rescue Publications website, learning management system (LMS), digital content, or any related services (collectively, the “Servicesâ€), you agree to be bound by these Terms and Conditions and all applicable laws of the Province of Ontario and the federal laws of Canada applicable therein. If you do not agree to these Terms, you must not access or use the Services.

Eligibility and accounts

To enrol in online courses or access restricted training content, you may be required to create a user account and provide accurate, current, and complete information. You must be of legal age to contract in your province or territory of residence, or have the consent of a parent, guardian, or authorized representative. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Apex Rescue Publications may suspend or terminate accounts that provide false information or breach these Terms.

Use of materials and license

Apex Rescue Publications grants you a limited, personal, non‑exclusive, non‑transferable license to access and view course materials, documents, and resources solely for your own training, professional development, or organizational education purposes. All content, including text, graphics, videos, assessments, and downloads, is protected by the Canadian Copyright Act and other applicable intellectual property laws, and remains the property of Apex Rescue Publications or its licensors. You may not copy, modify, reproduce, distribute, resell, or create derivative works from any materials without prior written consent.

Online course enrolment and payments

Access to certain courses, certifications, or digital products may require payment of fees, which will be displayed at the time of enrolment or purchase. By submitting payment information, you represent that you are authorized to use the selected payment method and agree to pay all applicable fees, taxes, and charges in accordance with any posted pricing and billing terms. Unless otherwise stated in a specific course description or written agreement, fees for digital and online training services are non‑refundable once access has been granted, subject to any non‑waivable rights you may have under Ontario’s Consumer Protection Act, 2002.

User conduct and LMS rules

You agree to use the LMS and Services in a lawful, respectful, and professional manner and in compliance with all applicable laws and regulations. You must not:

• share or sell your login credentials;
• attempt to bypass security or access controls;
• upload viruses or malicious code;
• engage in harassment, abuse, or discriminatory behaviour; or
• interfere with the normal operation of the Services.

Apex Rescue Publications may, in its sole discretion, suspend or terminate access where misuse, academic dishonesty, or other violations of these Terms are detected.

Professional and safety disclaimers

Training content is designed to support education in fire, rescue, and safety operations but does not replace formal certification, employer training, local standard operating guidelines, or regulatory requirements. Users, employers, and agencies remain solely responsible for ensuring personnel are properly trained, certified, supervised, and compliant with applicable codes, standards, and legislation before performing any real‑world operations.

Disclaimer of warranties

The Services and all content are provided on an “as is†and “as available†basis without any warranties or representations of any kind. Apex Rescue Publications disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non‑infringement, to the fullest extent permitted by the laws of Ontario and Canada.

Limitation of liability

To the maximum extent permitted by law, Apex Rescue Publications, its directors, employees, contractors, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, income, or business, arising out of or in connection with your use or inability to use the Services. This limitation applies whether the claim is based in contract, tort, negligence, strict liability, or any other legal theory, even if Apex Rescue Publications has been advised of the possibility of such damages.

Privacy and data protection

Personal information collected through the website or LMS is handled in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable Ontario privacy laws. By using the Services, you consent to the collection, use, and disclosure of your information as described in the Apex Rescue Publications Privacy Policy, which is incorporated by reference into these Terms.

Intellectual property

All trademarks, logos, trade names, course designs, and other intellectual property appearing on or within the Services are owned by Apex Rescue Publications or used under license. Nothing in these Terms grants you any right or license to use such intellectual property without the prior written permission of the rights holder, and unauthorized use may result in legal action under Canadian law.

Modifications and service changes

Apex Rescue Publications may revise these Terms or modify, suspend, or discontinue any part of the Services at any time. Changes to the Terms will be effective when posted on the website, and your continued use of the Services after such changes are posted constitutes your acceptance of the updated Terms.

Governing law and jurisdiction

These Terms and any dispute or claim arising out of or relating to them or to the Services shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. You irrevocably attorn to the exclusive jurisdiction of the courts of the Province of Ontario.
